You agree that Alive may use and/or disclose information about your demographics and use of the Site in any manner that does not reveal your identity. By participating in Site sweepstakes, contests, promotions, and/or requesting promotional information or product updates, you agree that Alive may use your information for marketing and promotional purposes.

PRODUCT INFORMATION
Most Alive products displayed at the Site are available while supplies last. The prices displayed at the Site are quoted in U.S. Dollars and are valid and effective only in the United States.

We have made every effort to display as accurately as possible the colors of our products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.

INDEMNIFICATION
You agree to defend, indemnify and hold Alive harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Site.
MISCELLANEOUS
Unless otherwise specified and except to the extent Alive products are offered for sale in the United States through this Site, this Site and the Contents thereof are displayed solely for the purpose of promoting Alive products and services available in the United States and select foreign markets. This Site is controlled and operated by Alive from its offices in Orlando, Florida.
This Agreement shall be construed in accordance with the laws of the State of Florida, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and federal courts of the State of Florida, County of Dade.
TERMINATION
This Agreement is effective unless and until terminated by either you or Alive. You may terminate this Agreement at any time. Alive also may terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, if in Alive sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of this Agreement by either you or Alive, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the terms of this Agreement or otherwise.
DISCLAIMER
THIS SITE AND ALL CONTENTS OF THE SITE ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Taxes
Alive is located in Florida. For all orders shipped to or picked up in Florida applicable sales tax will be applied. Resellers, schools, churches, and other organizations must provide us with their reseller certificate or sales tax-exempt documentation to be exempt from sales tax.
No Refunds
Alive does not give refunds on products and services. If we made a mistake on your order we will correct the mistake because it is the right thing to do. If you are dissatisfied with your product because you did not completely understand the service we apologize. We stand by our no refunds policy and hope that no one places an order without completely understanding the products and services we provide. Alive may offer a credit for use with future purchases.
Order Cancellations
Once an order has been placed it cannot be cancelled. In some situations we may offer a credit for the purchase price but as per the No Refunds policy we cannot and will not offer a refund on a cancelled order.
Turn Around Times are Not Guaranteed
The turn around times provided by Alive are estimates based on our average workload. These times are not guaranteed. Every project is unique and each can have unforeseen delays. Please plan for this. Alive cannot be held liable for any delays in production or delivery and any resulting consequential damage or loss.
Rush Order Guarantees
If a customer purchases a rush service and the deadline is not met the customer may contact us to inquire about their options. If the error was on our behalf a refund or credit may be issued for the cost of the rush service. If the error was caused by the shipping provider the customer must file a grievance with the shipping carrier. Alive cannot be held liable for any delays in production or delivery and any resulting consequential damage or loss. Customers are only guaranteed 20% of their order by the due date.
Other Terms and Conditions
- Claims for damages, defects or shortages must be submitted in writing within 10 working days after the delivery of the product.
- In the event of a reprint, all of the original order must be returned. Shipping charges may apply.
- Alive reserves the right to use any items/photos designed and/or produced in future promotional pieces such as magazine ads, fliers, websites or any other promotional material. If you do not wish to be included please send a written request along with your Invoice Number.
- For legal purposes, the venue for any dispute shall be Orlando, FL USA.
- Prices, terms and conditions are subject to change without notice. Please read all information on our website before submitting your order. Alive cannot be held liable for any misinterpretations.
- OverRuns/UnderRuns on all orders are subject to a variation of +/- 3%. There will be no charges or credits for these.
- Cancellation of an order after acknowledgement will result in charges for any transaction fees and setup costs incurred before cancellation.
